Safeway Unit Wants Fed. Circ. To Kill $3.5M Patent Verdict

Law360, New York (July 12, 2013, 4:56 PM EDT) -- A Safeway Inc. subsidiary on Thursday urged the Federal Circuit to reverse a jury's $3.5 million patent infringement verdict over its use of computer technology used for processing gift cards, saying the jury's decision is based on faulty claim constructions.

Blackhawk Network Inc, Safeway's gift card unit, said U.S. Magistrate Judge Stephen Crocker, who oversaw the trial, misconstrued two claims related to the patent-in-suit. Last year, a jury determined that Blackhawk had infringed the patent held by rival Interactive Communications International Inc.
