SigmaPharm Gets Skelaxin Suit Sent Back To Pa. Court

Law360, Los Angeles (July 16, 2013, 7:30 PM ET) -- A Pennsylvania federal judge Tuesday remanded to state court SigmaPharm Inc.’s lawsuit accusing Mutual Pharmaceutical Co. Inc. and others of conspiring to suppress the release of generic forms of muscle relaxant Skelaxin, ruling she lacked jurisdiction over the case, which only asserts state law claims.

In a four-page ruling, U.S. District Judge Cynthia M. Rufe ruled she “never had subject-matter jurisdiction” in the civil racketeering lawsuit and sent the case back to the Court of Common Pleas of Philadelphia County.
