Ex-US Airways Pilot's ERISA Suit Preempted, DC Circ. Says

Law360, Los Angeles (July 19, 2013, 4:50 PM ET) -- The D.C. Circuit on Friday tossed an Employee Retirement Income Security Act lawsuit in which a former US Airways Group Inc. pilot suffering from leukemia sought benefits, ruling that the Railway Labor Act prevented the court from exercising jurisdiction over the case.

Michael S. Oakley claimed he was owed benefits through the airline's collectively bargained pilot disability plan, but the appeals court — upholding a lower court ruling — said the RLA preempted his ERISA claims and demanded that the case go to arbitration.
