Insurer Beats Workers Comp Claim Due to Wage Miscalculation

Law360, Dallas (July 19, 2013, 10:01 PM ET) -- A Texas appeals court ruled in favor of Indemnity Insurance Co. of North America on Thursday, saying the insurer isn't liable for supplemental workers compensation payments to an injured elevator installer because the state insurance department mistakenly included health benefits the company paid to a union in the man's average pay.

The Tenth District Court of Appeals, affirming the lower court, said the insurer doesn't have to compensate a former ThyssenKrupp Elevator Corp. worker who was injured on the job and then took a lower-paying position....
