Generic Won't Infringe Crestor Patent, Apotex Claims

Law360, New York (February 1, 2008, 12:00 AM EST) -- Apotex Inc. has slammed AstraZeneca Pharmaceuticals LP with a lawsuit accusing the drug maker of blocking a generic version of the cholesterol medication that is already the focus of several other patent infringement cases.

By listing the patent for the brand-name drug Crestor in the Food and Drug Administration's list of approved drugs, AstraZeneca has illegally stopped the generic version from ever going on sale, Apotex alleged in a complaint lodged on Thursday.
