Roche Loses Round In HIV Test Patent Case

Law360, New York (February 1, 2008, 12:00 AM EST) -- A federal appeals court has declined to vacate a decision that denied summary judgment to blood-screening test manufacturer Roche Molecular Diagnostics Inc. in a university’s suit over the ownership and license rights to HIV monitoring patents.

In a 2-1 ruling, the U.S. Court of Appeals for the Federal Circuit rejected Friday Roche’s request for a writ of mandamus, upholding the district court’s partial grant of summary judgment in favor of the Board of Trustees of the Leland Stanford Junior University.
