4th Circ. Bars Suit Against Pentagon Over Military Rapes

Law360, New York (July 24, 2013, 1:19 PM ET) -- The Fourth Circuit ruled Tuesday that 28 military members and veterans couldn't sue the past two secretaries of defense over allegations of rape and sexual assault by fellow service members.

Although the appeals court acknowledged the severity of accusations — that former defense secretaries Donald Rumsfeld and Robert Gates contributed to a culture of tolerance for sexual violence in the military — it nonetheless said federal courts simply do not have the right to intervene in military matters.
