Farmers OT Class In Jeopardy After Depublished Ruling

Law360, New York (July 24, 2013, 4:10 PM EDT) -- A California appeals court on Tuesday ordered a lower court to reconsider class certification for a group of Farmers Insurance Exchange employees who claim the insurer didn't pay them overtime wages, citing the recent depublishing of a key ruling.

The Second Appellate District agreed with Farmers that a lower court should have granted reconsideration of its class certification order after the state's Supreme Court ordered the underlying ruling — Harris v. Superior Court — depublished in October.
