Manufacturing Co. Loses Military Supply Contract Protest

Law360, New York (July 24, 2013, 5:59 PM EDT) -- The U.S. Court of Federal Claims on Wednesday dismissed Excel Manufacturing Ltd.'s challenge to a contract awarded to Tennier Industries Inc. to supply trousers and cold-weather parkas to the U.S. military, finding that Excel didn't accurately calculate Tennier's ability to meet a subcontracting requirement.

Nothing about Tennier's proposal to the Defense Logistics Agency indicated that the company couldn't meet a clause in the contract requiring it to complete at least 50 percent of the work, the court found in an order delivered last week but unsealed...
