An Update On Stays Pending PTAB Trial Proceedings

Law360, New York (August 15, 2013, 12:02 PM EDT) -- Eleven months have passed since Sept. 16, 2012, the date the Patent Trial and Appeal Board started accepting petitions for inter partes review and the transitional program for covered business method patents. Through the end of May, 261 petitions for IPRs and 28 petitions for CBMs have been filed, and 94 IPR and 15 CBM petitions have been decided. The PTAB instituted 86 IPRs and 12 CBMs, while declining eight IPR and three CBM petitions.[1] Petitions for post-grant review and derivation proceedings, the other new PTAB trial proceedings, do not appear to have been filed yet, which is not unexpected since those proceedings concern patents with effective filing dates of March 16, 2013, or later....
