6th Circ. Ruling Informs Sears Washer Case, Class Says

Law360, New York (July 30, 2013, 5:10 PM EDT) -- The Seventh Circuit should back the certification of a class of consumers suing Sears Roebuck & Co. over allegedly defective washing machines, the plaintiffs in the action said Monday, pointing to the Sixth Circuit's recent certification ruling in a nearly identical lawsuit.

The appeals court is considering the suit, which claims Whirlpool Corp. washers sold by Sears accumulated mold and contained defective central control units, for the second time. It ruled in November that class certification was appropriate for both the mold and control unit allegations....
