Aetna, UnitedHealth Escape Whistleblower FCA Suit

Law360, New York (July 31, 2013, 6:25 PM ET) -- Aetna Inc., UnitedHealth Group Inc., WellPoint Inc. and other health care providers escaped a False Claims Act lawsuit Tuesday when a California federal judge ruled that the whistleblower's allegations that the companies received inflated Medicare payments were overly vague.

Former SCAN Health Plan employee James M. Swoben alleged that his company, along with Aetna, WellPoint, UnitedHealth Group, HealthCare Partners Inc. and Health Net Inc. violated the False Claims Act by improperly submitting diagnosis codes to the Centers for Medicaid and Medicare Services to obtain higher payouts. SCAN...
