Calif. Court Denies Class Cert. In PG&E Easement Suit

Law360, New York (July 31, 2013, 9:57 PM ET) -- A California appeals court on Tuesday upheld a ruling denying class certification to landowners alleging Pacific Gas & Electric Co. wrongfully installed telecommunications cabling on easements across their properties, ruling the plaintiffs’ claims were too individualized to go forward as a class.

In an unpublished decision, a Court of Appeal panel affirmed a lower court’s ruling, finding Judge John E. Munter had correctly ruled that individual questions related to the disputed easement agreements and alleged damages predominated over common questions in the case.
