At EPA's Request, 7th Circ. Alters Ruling In CERCLA Suit

Law360, New York (July 31, 2013, 5:29 PM EDT) -- In an amended opinion, the Seventh Circuit clarified Wednesday that parties responsible for pollution can immediately resolve their liability upon settling with the U.S. Environmental Protection Agency and thus be protected from contribution claims by polluters, recognizing the regulator's concerns about an earlier ruling in a cleanup suit.

The Seventh Circuit did not reconsider its December 2012 decision to revive the suit against Auto Owners Mutual Insurance Co. and others, but it corrected parts of the opinion that improperly suggested that parties could never structure a settlement agreement...
