OT Claims In FLSA Suits Must Be Specific, 2nd Circ. Says

Law360, New York (August 5, 2013, 5:22 PM EDT) -- Clearing a Healthfirst unit of Fair Labor Standards Act claims, the Second Circuit said Monday that a lawsuit alleging an employer failed to properly pay overtime must include specifics about the purported violations and not simply rephrase the FLSA.

In a published opinion, the Second Circuit upheld the dismissal of overtime claims brought against Healthfirst's HF Management LLC by former employee Ramona Dejesus, finding that she did not present enough specific factual allegations to establish that HF might plausibly have violated the FLSA.
