Fed. Circ. Revives 3M Diaper Patent Suit

Law360, New York (August 6, 2013, 7:51 PM EDT) -- The Federal Circuit revived a 3M Co. suit over diaper patents against Tredegar Corp. on Tuesday, finding that the lower court misconstrued claim terms in a decision that prompted one judge to lament that ambiguous patent claims lead to an "unnecessary claim construction game."

3M accused Tredegar of infringing four patents covering laminates found in the waistband of products like diapers. After the district court issued an order construing the claims of 30 separate terms from the patents, the parties stipulated that Tredegar did not infringe....
