Municipality Can Amend Land Use Sans Preapproval: NJ Court

Law360, New York (August 7, 2013, 8:31 PM EDT) -- A New Jersey appellate panel Wednesday affirmed a municipality’s ordinance to amend its land-use plans in an environmentally sensitive area, ruling the municipality did not need the approval of the council responsible for coordinating the area’s land use.

A three-judge panel on the Superior Court of New Jersey’s Appellate Division sided with 189 Stryker Road Associates, the owner of an asphalt plant in Lopatcong Township, N.J., and the New Jersey Highlands Water Protection and Planning Council, which were challenged by neighboring Greenwich Township saying Lopatcong officials...
