'Non-Asians' Group Not Protected By Contractor Hiring Rules

Law360, New York (August 8, 2013, 9:33 PM EDT) -- A U.S. Department of Labor judge Monday ruled in favor of a clothing manufacturer that the Office of Federal Contract Compliance Programs accused of discriminating against non-Asian job applicants, saying the aggregated group “non-Asians” did not constitute “an ethnic group” protected by contracting regulations.

Administrative Law Judge Kenneth A. Krantz granted summary judgment to VF Jeanswear Limited Partnership on the OFCCP's claims that it discriminated against non-Asians in hiring at a now shuttered Winston-Salem, N.C., apparel manufacturing facility whose business included federal contracts.
