FLSA Doesn't Bar Class Waivers, 2nd Circ. Rules

Law360, New York (August 9, 2013, 12:55 PM EDT) -- The Second Circuit ruled Friday that the Fair Labor Standards Act does not contain a contrary congressional command that would prohibit the enforcement of class action waivers, holding that Ernst & Young LLP's individual arbitration agreement must be enforced in an overtime suit.
