Ericsson Says ITC Should Set Royalty Rates In SEP Cases

Law360, New York (August 9, 2013, 5:34 PM EDT) -- Ericsson Inc. told the U.S. International Trade Commission Wednesday that due to the recent White House veto of an exclusion order based on standard-essential patents, the ITC should start setting royalty rates for essential patents in future investigations.

Ericsson, which has asserted standard-essential patents in litigation, made the proposal in public comments submitted to the ITC as it weighs whether to review a judge's June decision that Nokia Corp. and others did not infringe InterDigital Communications LLC's essential wireless patents.
