Depomed Sues Banner, Watson Over Proposed Generic Zipsor

Law360, Washington (August 9, 2013, 6:35 PM EDT) -- Depomed Inc. hit Banner Pharmacaps Inc. and Watson Laboratories Inc. with an infringement suit in North Carolina federal court Friday, claiming the company's bid to launch a generic post-surgical acute pain medication violates five of its patents.

Banner's abbreviated new drug application for generic 25 milligram diclofenac potassium tablets will infringe five patents that protect its Zipsor drug, according to Depomed. Watson is the exclusive licensee of the generic drug candidate, the complaint says.
