NLRB Can Target Tribe’s Labor Code, 6th Circ. Told

Law360, New York (August 13, 2013, 8:29 PM EDT) -- The National Labor Relations Board insisted Monday that it has jurisdiction over an Indian casino in Michigan, urging the Sixth Circuit to uphold a March NLRB decision that found parts of a labor code allowing the tribe to ban strikes and regulate collective bargaining to be unlawful.

The NLRB's appellate brief said it had merely applied the established standard for ascertaining when to assert jurisdiction over Indian tribes and tribal enterprises, and requested that the appeals court reject the Little River Band Of Ottawa Indians' challenge...
