Kaleida Health Employees Lose Wage Suit In 2nd Circ.

Law360, Los Angeles (August 21, 2013, 5:52 PM ET) -- Hospital giant Kaleida Health dodged a wage-and-hour class action Wednesday when the Second Circuit found employees had failed to state a claim in their case accusing it of not paying them for meal breaks.

A three-judge appeals panel found that a New York federal judge had properly dismissed the employees’ claims that Buffalo, N.Y.-based Kaleida had violated the Racketeer Influenced and Corrupt Organizations Act by mailing pay stubs for overtime work.
