Prius Drivers Tell 9th Circ. Warranty Covers Fuel Tank Flaw

Law360, Los Angeles (August 26, 2013, 8:21 PM EDT) -- Prius drivers urged the Ninth Circuit on Monday to revive a putative class action alleging Toyota Motor Corp. improperly refused to repair their vehicles, saying a fuel tank defect that caused inaccurate gas gauge readings in cold weather was covered by Toyota's warranty.

Named plaintiffs Henry and Veronica Troup argued that a California federal judge who dismissed the case erred in finding the fuel tank problem was not a defect in “material and workmanship” but rather a defect in design that Toyota was not contractually obligated...
