Appeals Court Upholds TransCanada Land Seizure

Law360, Houston (August 27, 2013, 2:43 PM ET) -- TransCanada Corp. scored another win Tuesday in defense of its power to seize land through eminent domain proceedings, when a Texas appeals court ruled the energy giant can legally run a segment of its Keystone XL Pipeline through private property over a landowner’s objection.

The Sixth District Court of Appeals upheld TransCanada’s status as a “common carrier” under state law and said the company is therefore entitled to an easement across Julia Trigg Crawford’s 600-acre farm in North Texas to accommodate part of the 1,700-mile pipeline...
