Covidien's Surgical Seal Patent Win Upheld By Fed. Circ.

Law360, New York (August 27, 2013, 5:54 PM EDT) -- The Federal Circuit on Tuesday affirmed a decision that medical device company Covidien PLC did not infringe rival Applied Medical Resources Corp.’s patent covering technology for a gas-tight seal used with surgical instruments.

While the patent describes a device with a component known as an 'instrument seal assembly' that allows for free lateral movement, the court ruled that Covidien's accused products have an assembly that does not move laterally.
