Progress Energy, Engquist: Crucial High Court Cases

Law360, New York (February 12, 2008, 12:00 AM EST) -- This term, two cases have come before the Supreme Court that raise important questions about the statutory and constitutional protections available to employees. These cases are Progress Energy Inc. v. Taylor and Engquist v. Oregon Department of Agriculture.

The Supreme Court has invited the Solicitor General to file a brief in Progress Energy, which addresses the extent to which an employee is protected under the federal Family and Medical Leave Act of 1993 (the “FMLA”).
