9th Circ. Won't Block Calif. From Enforcing Foie Gras Ban

Law360, Los Angeles (August 30, 2013, 8:03 PM ET) -- The Ninth Circuit on Friday refused to prevent California from enforcing a statute banning the sale of products made from force-feeding birds to enlarge their livers, ruling the statute clearly states that the only food product it prohibits is foie gras.

The appellate court found that the animal cruelty statute is intended to bar the force-feeding of ducks and geese to enlarge their liver, the common method used to produce the delicacy, and that no other livestock product is produced via force-feeding.
