NLRB Ruling Dooms Nursing Home Labor Case In 3rd Circ.

Law360, New York (September 5, 2013, 2:36 PM ET) -- The Third Circuit on Wednesday vacated a lower court's temporary injunction against a New Jersey nursing home accused of punishing its workers for participation in union activities, finding that a National Labor Relations Board ruling in the case rendered the court's decision moot.

In a unanimous precedential opinion, a three-judge panel noted that both sides agreed that the NLRB decision against Bound Brook, N.J.-based Somerset Valley Rehabilitation & Nursing Center nullified the temporary injunction, but rejected arguments from the nursing home that the trial court's ruling...
