DOJ Ends Investigation Into Clean-Coal Trade Secrets Theft

Law360, Dallas (September 12, 2013, 7:05 PM EDT) -- The U.S. Department of Justice won’t prosecute Advanced Emissions Solutions Inc. after an investigation into whether the clean coal company stole trade secrets from competitor Texas-based Norit Americas Inc. during an attempted acquisition, the parties said Thursday.

Under the nonprosecution agreement, the DOJ agreed not to assess fines or pursue criminal, civil or administrative action against alternative energy company ADA-ES Inc. or its current or former employees and directors, and ADA pledged to continue a culture of corporate compliance and make payments on a $40.5 million...
