Ill. Court Reverses Sears Win In Tax Overcharge Suit

Law360, Chicago (September 13, 2013, 7:46 PM ET) -- An Illinois appeals court has revived a class action accusing Sears Roebuck and Co. of charging consumers excess sales tax on digital television converter boxes that were partially subsidized by the federal government, according to an opinion released Wednesday.

The three-judge panel ruled that a Cook County Circuit Court judge had erred in granting summary judgment to the retailer, finding the plaintiff had raised factual issues to support a claim under the state’s Consumer Fraud and Deceptive Business Practices Act.
