Fla. Judge Won't Stop Drug-Testing Suit Amid Gov.'s Appeal

Law360, Miami (September 19, 2013, 7:05 PM EDT) -- A Florida federal judge on Thursday refused to stay a suit challenging Gov. Rick Scott's plan for mandatory drug testing of state government workers while he appeals an Eleventh Circuit ruling to the U.S. Supreme Court, according to an attorney in the case.

U.S. District Judge Ursula Ungaro, who had ruled in April 2012 that Scott's plan was unconstitutional, said he has little chance of convincing the U.S. Supreme Court to take up the issue after the Eleventh Circuit already said the policy sweeps too broadly,...
