Law360, New York (September 24, 2013, 9:27 PM EDT) -- Video-sharing service Vimeo LLC learned the hard way last week that the Digital Millennium Copyright Act's safe-harbor provision for user-generated content isn't invincible if hosting sites aren't careful. The ruling should be a warning shot to rival sites.

In Vimeo's case, a New York federal judge found that its employees had posted comments or “liked” some of the allegedly infringing videos, meaning it wasn't totally clear whether the company had “actual or red-flag knowledge” of the illegal uploads.
