NY Court Revives Title Coverage Claim Over Bogus Mortgage

Law360, New York (September 26, 2013, 3:08 PM ET) -- A New York appeals court on Wednesday put United General Title Insurance Co. back on the hook for Countrywide Home Loans' breach-of-policy suit involving a convicted identity thief's bogus mortgage on a Staten Island property, reversing a trial court's summary dismissal.

A unanimous four-judge panel in the state's Second Judicial Department said Richmond County, N.Y., trial judge Judith N. McMahon moved too quickly in throwing out Countrywide's lawsuit, which was filed in 2012 after the title insurer had disclaimed coverage.
