Admiral Ordered To Defend Against 9/11 Injury Suits

Law360, New York (September 26, 2013, 7:05 PM ET) -- A New York federal judge ruled Wednesday that Admiral Indemnity Co. should defend a lower Manhattan property owner against multiple injury lawsuits stemming from the Sept. 11, 2001, terrorist attacks, unconvinced that the pollution exclusion applied.

U.S. District Judge Loretta Preska held that Admiral breached its contract with policyholder 120 Greenwich Development Associates LLC when it relied on the pollution exclusion to bar coverage for lawsuits that were modeled on the master complaint in the consolidated World Trade Center Lower Manhattan Disaster Site litigation.
