Kennedy, Waxman Vow To Intercept Medtronic Ruling

Law360, New York (February 21, 2008, 12:00 AM EST) -- Top Democrats on Capitol Hill have promised to legislate against the U.S. Supreme Court's decision Wednesday that a medical device company cannot be sued under state law if a device that has undergone the U.S. Food and Drug Administration's premarket approval process causes an injury.

Sen. Edward M. Kennedy (D-Mass.) and Rep. Henry A. Waxman (D-Calif.) promised legislation in reaction to the 8-1 decision of the high court in Riegel v. Medtronic.
