Power Transmission Co. Not Liable For Injury, Pa. Court Says

Law360, Philadelphia (October 02, 2013, 5:53 PM ET) -- The Pennsylvania Superior Court on Wednesday ruled that an electrical transmission company was not responsible for the injuries that an employee for a local electric utility suffered while repairing a power line, finding that it had immunity through a Federal Energy Regulatory Commission tariff.

The court overturned a trial court decision denying summary judgment to PJM Interconnection LLC in a suit brought by PPL Electric Utilities Corp electrician Marlin Yorty, finding that that the tariff trumped state law.
