10th Circ. Refuses To Stop Keystone Pipeline Construction

Law360, New York (October 10, 2013, 2:48 PM ET) -- A divided Tenth Circuit panel on Wednesday backed the rejection of a bid by environmental groups to halt construction of part of TransCanada Corp.'s contested Keystone XL pipeline, saying the groups hadn't shown the lower court abused its discretion in denying their preliminary injunction request.

Groups led by the Sierra Club argued that U.S. District Judge David L. Russell erred when he ruled in August 2012 that the groups weren't likely to succeed on the merits of their suit accusing the U.S. Army Corps of Engineers...
