LA Challenges $4M OT Award To Fire Dept. Employees

Law360, Los Angeles (October 11, 2013, 6:58 PM ET) -- The city of Los Angeles urged the Ninth Circuit on Friday to toss awards totaling $4.1 million to fire department dispatchers and other employees in two wage-and-hour cases, saying the municipal workers fall within an exemption from overtime compensation that applies to “fire protection activities.”

The exemption extends beyond firefighters who are actually on the scene of a fire trying to put it out, the city told a three-judge appellate panel, arguing that a California federal judge erred in granting the plaintiffs summary judgment on liability...
