High Court Rejects Nokia Call To Keep NPE Suits Out Of ITC

Law360, New York (October 15, 2013, 8:33 PM EDT) -- The U.S. Supreme Court on Tuesday refused to hear an appeal by Nokia Corp. seeking to overturn the Federal Circuit's rule that allows nonpracticing entities to file patent suits at the U.S. International Trade Commission simply by showing that they license their patents.

The justices turned aside Nokia's argument that the appeals court has improperly expanded the ITC's authority by ruling that companies such as InterDigital Communications LLC, which sued Nokia over wireless patents, can fulfill the trade forum's "domestic industry" requirement by licensing alone.
