In A&L Industries v. P. Cipollini Inc., No. 12-07598, 2013 U.S. Dist. (D.N.J. Oct. 2, 2013), the court held that under Fed. R. Civ. P. 23(b), "[a] class action is simply a better available method to fairly and efficiently resolve the claims of potential class members" in a suit brought under the TCPA. Id. at *17-18....
