Nestle, Ralston Merger Suit Kicked To Mo. High Court

Law360, New York (October 16, 2013, 12:19 AM EDT) -- A Missouri appeals court on Tuesday balked at affirming a state trial court's decision to toss a shareholder class action over an alleged breach of the agreement for Nestle Holdings Inc.'s 2001 acquisition of Ralston Purina Co., saying the Missouri high court should decide whether the case is time-barred.

A three-judge appellate panel said the Missouri Supreme Court should resolve the intermediate appeals courts' inconsistent interpretations of a 10-year statute of limitations for “[a]n action upon any writing ... for the payment of money or property.”...
