JPMorgan, Others Lose Bid For FHFA Docs In MBS Fight

Law360, New York (October 18, 2013, 2:21 PM EDT) -- A New York federal judge on Wednesday denied a bid by several banks including JPMorgan Chase & Co. and Barclays Bank PLC to compel the Federal Housing Finance Agency to produce about 22,000 documents related to the agency’s cases over toxic mortgage-backed securities, citing the FHFA's invocation of privilege.

U.S. District Judge Denise Cote found that despite the defendants' arguments to the contrary, the bank examination privilege applies to the FHFA as the regulator for Fannie Mae and Freddie Mac.
