Fed. Circ. Revives Bone Screw Patent Claim

Law360, Los Angeles (October 18, 2013, 6:23 PM ET) -- The Federal Circuit on Friday vacated a decision by the Patent Trial and Appeal Board affirming the rejection of claims in a patent application relating to a bone screw, saying the board improperly introduced new grounds for rejection. 

A three-judge appellate panel remanded for further proceedings the board's decision on a patent application filed by Lutz Biedermann and Jurgen Harms, rejecting the government's argument that the board merely provided new details to support the examiner's rationale.
