Judge Certifies Collective Action in Eli Lilly FLSA Suit

Law360, New York (February 26, 2008, 12:00 AM EST) -- A federal judge has granted conditional collective action certification for a group of current and former Eli Lilly pharmaceutical representatives who are suing the company for overtime wages, claiming that their positions should not be considered exempt under the Fair Labor Standards Act.

Judge Sarah Evans Barker granted the conditional certification Friday in the U.S. District Court for the Southern District of Indiana and ordered the Indianapolis-based pharmaceutical firm to produce a contact list for all those who could be included in the suit. In order...
