Medtronic Fined $10M For Attorneys' Misconduct

Law360, New York (February 26, 2008, 12:00 AM EST) -- The judge overseeing Johnson & Johnson subsidiary DePuy Spine Inc.'s patent suit against Medtronic smacked the defendants with a $10 million sanction for dragging out the proceedings and choosing a defense that threatened to mislead and confuse the jury.

While U.S. District Judge Edward Harrington on Monday denied plaintiffs DePuy and Beidermann Motech GmbH's motion for enhanced damages, he did impose a $10 million fine on Medtronic and also required the company to pay a portion of the plaintiffs' attorneys' fees.
