Fla. Hospital Calls Patient Record Destruction 'Accidental'

Law360, Miami (October 29, 2013, 5:41 PM ET) -- Halifax Hospital Medical Center, which is facing a False Claims Act suit accusing it of paying kickbacks for referrals, on Monday fought a bid by federal prosecutors to sanction the hospital over destroyed records, saying the documents were accidentally destroyed in a routine purge.

In a memorandum filed in the Middle District of Florida, Halifax said that it has produced more than 400 records during discovery and that no employee was ever told to destroy records because of the litigation. The 33 missing records — from...
