Political Ad Donor Rule Not Necessary, Judge Says

Law360, Washington (October 29, 2013, 2:53 PM EDT) -- A Washington, D.C., federal judge on Tuesday seemed set to strike down a Federal Election Commission rule allowing nonprofit organizations to run political issue advertisements without disclosing their donors, saying the rule doesn't seem necessary and creates multiple disclosure regimes.

U.S. District Judge Amy Berman Jackson criticized the agency for creating a complex donor disclosure regulatory regime for a seemingly small group of organizations that are now allowed to run the issue ads, saying the rules weren't supported by the administrative record.
