7th Circ. Says Reinsurer Liable For State Atty's Defense

Law360, New York (October 30, 2013, 8:46 PM ET) -- The Seventh Circuit affirmed on Wednesday a lower court’s finding that White Mountains Reinsurance Company of America is liable for the defense coverage in underlying wrongful arrest lawsuits against a former Illinois state attorney and Edgar County, Ill.

A three-judge panel affirmed an Illinois federal court’s ruling that sided with National Casualty Co. — which had originally borne those defense costs under a reservation of rights while contesting its obligation to provide coverage — and found White Mountains liable under a 1986 insurance policy.
