USPTO Sued For Refusing To Grant AIA Review

Law360, New York (November 5, 2013, 2:47 PM EST) -- A company that had its petitions for inter partes review denied by the U.S. Patent and Trademark Office has sued the agency, alleging that the denials exceeded its authority because the America Invents Act is designed to ensure that most petitions are granted.

In a complaint filed Oct. 15 in federal court in Virginia, Dominion Dealer Solutions LLC claims that its inter partes review petitions presented expert testimony that rival AutoAlert Inc.'s financial transaction management patents are obvious.
